Retreat Rental Agreement
Short Term Lease

The Wise Raven Retreat Property

This Short Term Lease is between the following:

  • ●      Wise Raven: The Wise Raven Retreat LLC, an Alaska Limited Liability Company, with its principal place of business at PO Box 242731, Anchorage, AK 99524
    Representative: Tracy Follett, email:  thewiseravenretreat@gmail.com; and 

●      Retreat Host: Information to be filled out during reservation.

 

The following definitions apply to this Agreement:

 

●      Retreat Property: Big Lake Alaska

●      Uses: Short Term Rental, Personal and Corporate Retreats

●      Start Date and Time: Designated in the reservation

●      End Date and Time: Designated in the reservation

●      Rental Fee: $75 per person per day

●      Due Date: 6 weeks prior to Start Date 

●      Security Deposit: $500

Background:

Wise Raven is the owner of the Retreat Property. Retreat Host desires to rent the Retreat Property from Wise Raven on behalf of the Retreat Host’s guests. The parties therefore agree as follows:

1.        Lease

Wise Raven hereby leases the Retreat Property to Retreat Host on an as-is basis. Retreat Host shall use the Retreat Property only for the specified Uses. Wise Raven shall deliver the Retreat Property to Retreat Host on the Start Date and Time as specified on the reservation. Retreat Host acknowledges that Wise Raven has not made any statements or promises as to the suitability of the Retreat Property for the Uses. 

2.        Term | Return

The Term of the lease starts on the Start Date and Time and ends on the End Date and Time, as set on the reservation. Upon the End Date and Time, Retreat Host and all guests shall vacate the Retreat Property and shall return the Retreat Property and all personal property pertaining to the Retreat Property to Wise Raven in the same condition as when it started using the Retreat Property, ordinary wear and tear excepted. Retreat Host shall remove all of its property, including all of its guests’ property, from the Retreat Property prior to the End Date and Time. Retreat Host and all guests in the party waive all claims against Wise Raven for the removal or retainage of the property and shall pay for all of Wise Raven’s costs for storing, removing, returning, or disposing of such property. 

3.        Rental Fee

3.1      Payment of Rent. Retreat Host shall pay the Rental Fee to Wise Raven for the Term to Wise Raven’s address or to the place that the Wise Raven’s designates in writing to Retreat Host. Retreat Host shall pay the Rent to Wise Raven without deductions, setoffs, prior notice, or demand, except as otherwise specified in this lease. Retreat Host shall pay a late charge equal to 5% of any Rental Fee not paid upon the Due Date. Retreat Host shall pay all reasonable attorney’s fees expended to collect under this agreement.

3.2      Each Retreat Guest is Jointly and Severally Liable. Each of the Retreat Host’s guests shall be jointly and several liable for payment of all Rental Fees, Security Deposit and all other fees in this agreement. 

4.        Utilities

Wise Raven shall pay for all Utilities associated with the Retreat Property. If Wise Raven is the cause of a disruption to any Utilities necessary for the Uses, then Wise Raven shall refund the Rental Fee in an amount proportional to the length of the disruption.

5.        Security Deposit

Retreat Host shall pay Wise Raven the Security Deposit upon the effective date of this Agreement. Wise Raven shall apply the Security Deposit to the Rental Fee less any amounts to repair damages to the Retreat Property caused by Retreat Host or its guests.

6.        Retreat Host Responsibilities

6.1      Retreat Rules and Regulations. Wise Raven reserves the right to implement rules and regulations that govern the use or occupation of the Retreat Property. Retreat Host shall read and shall cause its guests to read such rules and regulations and shall comply with them. 

6.2      Maintenance of the Retreat Property. Retreat Host shall maintain and cause its guests to maintain the Retreat Property in good condition and shall keep it in a clean, orderly, safe, and sanitary condition. Host and its guests will use in a reasonable manner all electrical, plumbing, heating, and other services, facilities and appliances provided by the landlord. Host and its guests will dispose of rubbish and other waste in trash receptacles. Host and its guests will not intentionally or negligently destroy, deface, damage, impair or remove parts of the premises, appurtenances, equipment, furnishings or fixtures. 

6.3      Use and care of retreat Property. Retreat host and its guests will not have animals or pets on the property. Smoking on premises, or directly outside in any area that would disturb the air quality of the home and property is not allowed. This includes all legal, illegal and medicinal products, whether in cigarette, cigar, pipe, vape, e-cigarettes, or any other form. Guests will not have or keep on the premises any article or thing of a dangerous, flammable, or explosive character that might substantially increase the danger of fire on the premises, or that might be considered hazardous by a responsible insurance company.

6.4      Parking and noise ordinances. Retreat host and its guests will park their vehicle(s) in an appropriate manner only in the areas designated for guest parking. Retreat host and its guests will also conduct themselves in a manner that will not unreasonably impair or diminish their neighbor’s peaceful enjoyment of the premises.

6.5      Jointly and Severally Liable. The Retreat Host and its guests will be jointly and severally responsible for ensuring that all obligations set forth in this agreement, including the obligation to pay the fees in this agreement.

7.        Wise Raven’s Access 

Wise Raven shall make reasonable efforts not to interrupt Retreat Host’s or its guests’ enjoyment of the Retreat Property during the Term. Notwithstanding, Wise Raven may access the Retreat Property or portions thereof with prior notice to Retreat Host for the purpose of inspection, maintenance, or repair. Wise Raven may access the Retreat Property without notice in cases of emergency.

8.        Assignment and Subletting 

Retreat Host nor its guests shall not assign this lease or its rights under this lease nor sublease the Retreat Property or any part thereof without the express written consent of the Wise Raven.

9.        Insurance | Liability

Retreat Host shall carry a reasonable amount of insurance to protect their interests and interests of its guests, including travel, vacation, and short-term renter’s insurance. To the fullest extent permitted by law, each Retreat Host shall indemnify Wise Raven against any and all liability, claims, penalties, damages, expenses, costs, injury, or breach of contract of whatsoever kind or nature resulting from the actions or failure to act by such Retreat Host or any other individual or entity which accompanies the Retreat Host, including reasonable attorney’s fees necessary to defend any action brought by any party or entity.

10.      Compliance with Laws 

Retreat Host shall promptly execute and comply with all present and future laws, statutes, ordinances, orders, codes, permits, rules and regulations of all federal, state, and local governments, departments, commissions, agencies and boards regarding the Uses of the Retreat Property and its duties under this lease.

11.      Disputes

If there is a dispute between Wise Raven and Retreat Host or its guests, then all parties should do its best to resolve it outside of court. If it can’t be resolved, then all the parties to this agreement will consider mediation or arbitration to resolve the matter. As a last resort, any of the parties to this agreement can bring a claim to court. If that happens, then all the parties to this agreement knowingly, voluntarily and intentionally waive the right they may have to a trial by jury in respect to any litigation arising out of, under, or in connection with this agreement and all other agreements executed or contemplated to be executed in connection herewith. Anchorage, Alaska is the exclusive venue for all claims arising out of this agreement.

 

12.      Miscellaneous

This lease contains the entire agreement among the parties. The parties may amend this lease in a writing signed by all parties. Alaska law controls this lease. The parties shall give all notices required in this lease to the addresses specified above as follows (deemed received as specified in parentheses): by hand (upon delivery), via overnight FedEx or UPS (24 hours after deposit), by email (email confirmation), or by first class certified or registered mail, return receipt requested, postage prepaid (48 hours after deposit in the mail). Waivers must be in writing. No clause is to be construed against another party since this lease was negotiated in the spirit of mutual cooperation. Neither party is liable for force majeure events. Retreat Host nor its Guest shall not record this lease but may record a memorandum thereof. 

 

SIGNATURES AND DATES

By typing your name and dating it on the reservations page, this serves as your electronic signature of agreement to the Short Term Lease. 

The date this lease is signed by the Group Leader (as indicated by the date associated with that party’s elecrtronic signature) is the effective date of this lease.
